Terms of Service for Veilglass

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Hanshew BSF Limited ("Company", "we", "us", or "our"), a company registered in the United Kingdom, governing your use of the Veilglass mobile application ("App" or "Service").

2. Description of Service

Veilglass is a location-based mobile exploration game that allows users to:

• Explore real-world locations and "clear fog" on an interactive map
• Track their movement and create a visual journal of places visited
• Discover and collect Points of Interest (POIs) based on their location
• Access premium features through optional subscriptions

The App requires GPS location access to function and may continue tracking your location even when running in the background or when your device screen is locked.

3. Eligibility and Account Creation

3.1 Age Requirements

• You must be at least 13 years old to use this App
• Users under 13 must have explicit parental or guardian consent
• Users aged 13-15 in the UK should have parental supervision when using location-based services
• By using the App, you represent that you meet these age requirements or have obtained necessary consent

3.2 Account Registration

To use certain features of Veilglass, you must create an account by providing:

• A valid email address
• Authentication through Firebase (email/password or Google Sign-In)
• Acceptance of these Terms and our Privacy Policy

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4. License and Usage Rights

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial purposes

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for any illegal, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to any part of the Service or related systems
• Use automated systems (bots, scripts) to interact with the App or manipulate gameplay
• Sell, rent, lease, or sublicense your account or access to the App
• Use the App in any way that could damage, disable, or impair the Service
• Collect or harvest any user data without consent
• Impersonate another person or entity

5. Location Services and Safety

5.1 Location Permissions

Veilglass requires access to your device's location services to provide core functionality. By using the App, you consent to:

• Collection of precise GPS location data
• Background location tracking when the App is not in active use
• Storage and processing of your location history

5.3 Assumption of Risk

You acknowledge and agree that:

• Outdoor exploration carries inherent risks
• You are solely responsible for your own safety while using the App
• We are not liable for any injuries, accidents, or damages that may occur while using the App

5.4 Location Accuracy

We strive for accurate location tracking, but:

• GPS accuracy can vary based on device, weather, and environmental conditions
• We do not guarantee the accuracy, completeness, or reliability of location data
• Map data is provided by OpenStreetMap and may contain errors or be outdated

6. Subscriptions and Payments

6.1 Subscription Plans

Veilglass offers optional premium subscriptions:

• Monthly Subscription: Access to premium features, billed monthly
• Yearly Subscription: Access to premium features, billed annually

Subscription prices and features are displayed in the App and may vary by region.

6.2 Billing and Renewal

• Subscriptions are processed through Google Play Billing
• Your subscription will automatically renew unless you cancel before the renewal date
• You will be charged through your Google Play account at the start of each billing period
• Prices are subject to change with notice; existing subscribers will be notified of price changes

6.3 Cancellation

To cancel your subscription:

• Go to your Google Play Store account settings
• Navigate to Subscriptions → Veilglass
• Select "Cancel Subscription"
• Your access to premium features will continue until the end of the current billing period

6.4 Refunds

• Refunds are handled according to Google Play's refund policy
• Generally, refunds are not provided for partial subscription periods
• In exceptional circumstances, contact us at contact@project-enra.com to request a refund
• We reserve the right to grant or deny refund requests at our sole discretion

6.5 Free Trial

If we offer a free trial:

• You may be required to provide payment information
• You will be charged when the trial period ends unless you cancel before that time
• Free trials are limited to one per user

7. User Content and Data

7.1 Your Data

You retain ownership of your personal data, including:

• Location history
• Game progress and achievements
• Account information

7.2 License to Use Your Data

By using the App, you grant us a worldwide, non-exclusive license to:

• Store and process your data to provide the Service
• Use anonymized, aggregated data for analytics and improvement purposes
• Display your gameplay achievements within the App (if applicable)

7.3 Data Backup

While we strive to maintain reliable cloud saves:

• We are not responsible for loss of data due to technical failures
• We recommend periodically ensuring your progress is saved
• In the event of data loss, we will make reasonable efforts to restore data but cannot guarantee recovery

8. Intellectual Property Rights

8.1 Our Rights

All rights, title, and interest in and to the App and Service, including:

• Software code, design, and architecture
• Trademarks, logos, and branding (Veilglass, Project Enra)
• Game mechanics and features
• Documentation and materials

are owned by Hanshew BSF Limited and are protected by copyright, trademark, and other intellectual property laws.

8.2 Third-Party Rights

The App uses third-party services and data:

• OpenStreetMap: Map data © OpenStreetMap contributors, available under the ODbL
• Firebase: Services provided by Google LLC
• Unity Engine: Game engine by Unity Technologies

9. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Cheating: Using GPS spoofing, location manipulation, or other methods to falsify your location
• Account Sharing: Sharing your account credentials with others
• Multiple Accounts: Creating multiple accounts to circumvent restrictions or gain unfair advantages
• Harassment: Harassing, threatening, or abusing other users or our staff
• Exploiting Bugs: Knowingly exploiting bugs or glitches for personal gain
• Interfering with Service: Actions that disrupt or interfere with the Service or servers
• Data Mining: Using automated tools to extract data from the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Emailing us at contact@project-enra.com with a deletion request
• Following the account deletion process described in our Privacy Policy

10.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Service
• You engage in prohibited conduct
• We suspect fraudulent, abusive, or illegal activity
• We discontinue the Service
• Required by law or regulatory authorities

10.3 Effects of Termination

Upon termination:

• Your license to use the App immediately ceases
• Your data may be deleted in accordance with our Privacy Policy
• Active subscriptions may be cancelled (without refund if terminated for violations)
• Sections of these Terms that should survive termination will continue to apply

11. Disclaimers and Warranties

11.1 "AS IS" and "AS AVAILABLE"

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation

11.2 No Guarantee of Availability

We do not guarantee that:

• The App will always be available or accessible
• The Service will be uninterrupted or free from errors
• Defects will be corrected
• The App will be compatible with all devices or operating systems

11.3 Third-Party Services

We are not responsible for:

• The availability or accuracy of third-party services (Firebase, OpenStreetMap, etc.)
• Changes to third-party services that affect the App's functionality
• Third-party privacy practices or data handling

12. Limitation of Liability

12.1 Disclaimer of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANSHEW BSF LIMITED SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or unavailability
• Errors, mistakes, or inaccuracies in the Service
• Personal injury or property damage resulting from use of the App
• Unauthorized access to or alteration of your data
• Third-party conduct or content

12.2 Liability Cap

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100 (ONE HUNDRED POUNDS STERLING), WHICHEVER IS GREATER.

12.3 UK Consumer Rights

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under UK law

These Terms do not affect your statutory rights as a consumer under UK law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hanshew BSF Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Changes to the Service

14.1 Modifications

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Change features, functionality, or content
• Impose limits on usage or storage
• Update the App with new versions

14.2 No Liability for Changes

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

15. Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date
• For material changes, we will notify you via email or in-app notification
• Continued use of the App after changes constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you must stop using the App

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

16.2 Jurisdiction

You agree that any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before pursuing formal legal action, we encourage you to contact us at contact@project-enra.com to attempt to resolve the dispute informally.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hanshew BSF Limited regarding the use of the App and supersede all prior agreements and understandings.

19. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
